1. Key Terms
PeerVault.in is a digital platform operated by AALPHA INFORMATION SYSTEMS Pvt. Ltd., referred to as “PeerVault,” “we,” “us,” or “our.” We connect individuals (“Hosts”) offering storage space (“Space”) with those in need of storage (“Renters”). Our services (“Services”) include our web and mobile applications, software solutions, customer support, beta versions, and the content of our website, www.PeerVault.in (“Site”). These Services may also be promoted through various marketing channels at our discretion.
The term “Host” refers to a person who lists and provides Space for storing items (“Stored Items”). The term “Renter” refers to a person who is granted a temporary license to use the Host’s Space for storage purposes. “Space” is defined as any part of the Host’s property that is licensed or rented out. A “Listing” is the searchable profile advertising the Host’s Space. A “Booking” is the agreement where a Renter stores items in the Host’s Space.
A “Member” is anyone who creates a PeerVault account. “PeerVault Content” includes all content we provide through the Site, except for content posted by Members (“Member Content”). “Collective Content” includes both Member Content and PeerVault Content. “Content” refers to text, graphics, images, software, audio, video, information, or other materials.
2. Terms Relating to Service
2.1 PeerVault’s Role: PeerVault.in provides a digital marketplace that enables Hosts and Renters to connect and arrange storage bookings. PeerVault is not a property owner, real estate broker, insurer, or escrow agent. Our role is strictly to facilitate the use of our Site and Services. We are not involved in any user interactions except for processing payments and assisting with disputes as outlined in these Terms. PeerVault disclaims all liability related to user conduct.
2.2 Acceptance of Terms: By using PeerVault.in, you agree to adhere to our Terms of Service. These Terms are a legal contract between you and PeerVault, governing the use of our Site and Collective Content. Non-compliance may lead to access restrictions and legal consequences.
2.3 User Agreements: PeerVault is not involved in agreements between Hosts and Renters. Disputes should be resolved independently, without involving PeerVault, unless required by these Terms. Agreements between Hosts and Renters take precedence over these Terms but do not affect obligations to PeerVault.
2.4 Legal Compliance: You are responsible for understanding and complying with laws related to your use of the Space. PeerVault does not provide legal advice; consult a legal professional for guidance.
2.5 Listings and Spaces: PeerVault does not oversee the Listings or the Spaces offered. We are not liable for the content of Listings or the condition of Spaces.
2.6 User Consent: By using PeerVault.in or its services, you confirm that you’ve read and agreed to our Terms. This applies even if you haven’t registered on our platform. If you’re accepting these Terms for an entity, you confirm that you’re authorized to do so. “You” and “your” will then refer to that entity.
2.7 Age Limitation: PeerVault.in is for individuals 18 and older. If you’re under 18, you’re not permitted to use our Site or Services.
2.8 Lien Agreement: By booking storage space through PeerVault.in, you agree to a lien on your stored items, which allows PeerVault to sell these items if necessary to settle the lien.
3. Nondiscrimination Policy
3.1 Equal Opportunity: PeerVault.in is committed to creating an inclusive environment that welcomes members from diverse backgrounds. All members must adhere to applicable laws on non-discrimination. Discrimination based on race, color, ethnicity, national origin, religion, sexual orientation, gender identity, marital status, or disability is strictly prohibited. This includes, but is not limited to:
- Refusing service
- Imposing unequal terms
- Making discouraging statements in listings
3.2 Respectful Interaction: Hosts must communicate respectfully and provide reasonable accommodations for Renters with disabilities. Any form of communication barrier or additional charges based on disability is not allowed.
3.3 Community Integrity: Hosts are expected to foster a welcoming atmosphere. Repeated rejection of Renters from protected classes, even with valid reasons, can lead to removal from the PeerVault platform.
This policy ensures that PeerVault.in remains a place where everyone has equal access to services, regardless of their background or abilities.
4. Accounts
4.1 Integration with Third-Party Accounts: You may link your PeerVault Account with external third-party accounts. By doing so, you authorize PeerVault to access and store content from these accounts to enhance your experience on our platform. You confirm that sharing this information does not violate any agreements with third-party providers. Note that if the third-party service is unavailable or disconnected from PeerVault, the content will no longer be accessible through our services. You can manage these connections in your account settings.
4.2 Content from Third-Party Services (SNS Content): PeerVault does not review content from third-party services for accuracy or legality. Responsibility for SNS Content lies with you and the third-party providers.
4.3 Account Creation and Maintenance: Your PeerVault Account and profile are created using your personal details or those from linked third-party accounts. You must maintain only one active PeerVault Account and ensure all provided information is accurate and up-to-date. Changes to contact details must be reported through the PeerVault Site. Renters should provide a secondary contact for emergencies. Hosts must supply valid bank details for payments. PeerVault may suspend or terminate accounts for reasons including multiple accounts, inaccurate information, or terms violations.
4.4 Password Security: Keep your password confidential and accept responsibility for your PeerVault Account activities. Report unauthorized access immediately to [email protected].
4.5 Communication Consent: By providing your contact details to PeerVault, you consent to receive all service-related notices via the email address you’ve given us. This includes communications through various methods such as mail, calls, text messages, and emails from PeerVault or our partners. You’re also agreeing to be informed about new or future services. You can withdraw this consent at any time by reaching out to [email protected].
5. Listings
5.1 Creation Of Listings: As a registered Member of PeerVault.in, you have the privilege to create Listings for the Space you wish to rent out. During the listing process, you’ll be prompted to provide comprehensive details about the Space, such as its exact location, dimensions, unique features, availability schedule, pricing, and any specific rules or financial terms associated with it. To ensure your Listing is searchable and bookable on our platform, a valid physical address is mandatory. Once your Listing goes live, it becomes accessible to the entire PeerVault community, allowing other Members to discover and book your Space based on the information you’ve provided.
5.2 Host’s Accountability For Listings: As the creator of a Listing, you bear full responsibility for its content. It’s crucial that you confirm that your Listing and the subsequent Booking or usage of the Space will not violate any existing third-party agreements. You must possess the rightful ownership, lease, or permissions necessary to offer the Space for rent. Additionally, your Listing must adhere to all relevant legal requirements, including but not limited to zoning laws, licensing mandates, and regulations pertaining to property rentals. It’s important to note that PeerVault.in does not take on the responsibility to verify the legal compliance of your Listings.
5.3 PeerVault’s Discretion To Remove Listings: PeerVault.in reserves the unilateral right to remove or restrict access to any Listing at any time, without the need for prior notice. This action may be taken for a variety of reasons, such as if a Listing is deemed objectionable, violates our Terms, contravenes applicable laws, or is considered detrimental to the PeerVault community or the integrity of the Site and Services.
5.4 Host-Imposed Requirements: When crafting your Listing, you have the option to establish certain criteria that Members must meet to be eligible to book your Space. These criteria can range from having a verified profile picture to linking a social media account or providing a verified phone number. Renters must fulfill these specified requirements to proceed with a Booking. Additionally, Renters and their associates are expected to abide by any stipulations and policies you set forth in your Listing or as mutually agreed upon. Non-compliance with these rules could lead to the Renter being held in default and potentially liable for any damages incurred to the Space or property.
5.5 Integrity Of Space Description: It is imperative that you, as a Host, provide an honest and precise portrayal of the Space in your Listing. Any misrepresentation or inaccuracy in describing the Space can prompt PeerVault.in to determine the appropriate refund to the Renter, if warranted. Furthermore, such discrepancies may invalidate any applicable guarantees and could result in withholding of payments to you, the Host, or even legal action for breaching these Terms. If a Renter believes the actual Space falls short of the Listing’s description or is not as expected, they reserve the right to reject the Space. However, once the Renter moves their Stored Items into the Space, it is taken as confirmation that the Listing description was satisfactory.
5.6 Host’s Liability: As a Host on PeerVault.in, you are accountable for your actions and those of anyone you allow at the Space, except for the Renter and their guests. You must utilize available security measures to safeguard Stored Items. If your actions or negligence cause damage or loss, including triggering a payout under a Protection Plan, you are liable to reimburse PeerVault.in. You are also expected to cooperate with PeerVault.in by providing information about Bookings, Listings, and any incidents involving Stored Items.
5.7 Tax Obligations: It is your responsibility to understand and fulfill your tax obligations. PeerVault.in does not provide tax advice. Hosts must determine and include any applicable taxes in their Listings. PeerVault.in is not responsible for tax notifications, collections, or payments.
5.8 Platform-Exclusive Payments: All transactions must occur through the PeerVault.in platform. Direct solicitation for off-platform leases or payments is prohibited. Violations can lead to account termination and financial penalties equivalent to 24 months of total fees. Disputes over direct payments are strictly between Hosts and Renters, excluding PeerVault.in.
6. Payment Authorization
6.1 Billing Information: When you make a Booking on PeerVault.in, you’ll need to provide standard billing details such as your name, billing address, and payment information. This information may be collected by PeerVault or a designated third-party payment processor. If a third-party service is used, be aware that their terms and privacy policy will apply.
6.2 Payment Authorization: By proceeding with a Booking, you authorize PeerVault or its third-party processor to charge the payment method you’ve provided. This includes all fees associated with the Booking.
6.3 Third-Party Fees: PeerVault.in is not responsible for any additional bank fees that may be charged to you during the payment process.
7. Booking and Financial Terms
7.1 Booking Decisions: Hosts on PeerVault.in must respond to Booking requests within 24 hours. Upon a request, we’ll share the Renter’s full name, intended storage items, Start Date, and their profile link. Failure to respond will result in an automatic decline and a refund to the Renter. Confirmed Bookings will be communicated to both parties, and the Space’s address will be disclosed to the Renter.
7.2 Fee Structure: Listings show Total Fees, including Space Fees set by the Host, Service Fees as a percentage of Space Fees, Processing Fees for payment transactions, and, if applicable, Protection Plan fees and taxes. These fees are typically displayed monthly and are non-refundable, except as stated in these Terms.
7.3 Renter’s Financial Commitment: Renters agree to pay the Total Fees for confirmed Bookings associated with their PeerVault Account. Payments must align with the methods and terms outlined on the Site.
7.4 Recurring Payments and Host Payouts: Upon Booking confirmation, PeerVault.in will collect the Total Fees from the Renter. The Booking period typically runs month-to-month starting from the Start Date. Hosts receive Space Fees at the end of each Monthly Period. Renters are subject to Recurring Payments at the start of each Monthly Period. If prorated fees are agreed upon for the first month and approved by PeerVault.in, and the Booking is canceled before the second month’s charge, the Renter will be billed the difference between the prorated and full monthly fee. Renters agree that charges through PeerVault.in are in line with these Terms. Hosts understand that Space Fees, minus Service and Processing Fees, will be deposited into their accounts. Failure to dispute a charge within 30 days constitutes a waiver of any claims related to that charge.
7.5 Disclosure Requirements for Renters: Renters must disclose the items they intend to store, especially Protected Property, which includes sensitive documents, alcohol, non-personal use pharmaceuticals, and firearms. In Nevada, storing Protected Property related to regulated professions requires notifying the relevant agency and providing a copy of this notice to PeerVault.in and the Host. Renters must also disclose any liens or third-party ownership of Stored Items. Changes to Stored Items post-Booking must be updated on the platform and communicated to the Host. PeerVault.in and Hosts are not liable for undisclosed items, and Renters bear responsibility for any resulting damages.
7.6 Access to Space: Renters must arrange access to the Space with the Host, typically requiring at least 24 hours’ notice, unless a different agreement is in place. Hosts are expected to provide reasonable access as detailed in the Listing and maintain communication regarding any changes that might affect storage terms.
7.7 Handling Stored Items: Hosts are advised against transporting or handling Renters’ Stored Items. Any such actions taken by the Host are at their own risk. Renters should not provide vehicle keys to Hosts; if they do, it’s at the Renter’s risk, and PeerVault.in is not liable for any resulting issues.
7.8 Move-Out Responsibilities: Renters must vacate the Space and remove all items by the end of the Booking period, leaving it clean and tidy. Failure to do so may incur additional fees. Once the Space is cleared and the Booking is canceled, the Renter relinquishes any further rights to the Space.
7.9 Cancellation by Renter: It is solely up to the Renter to cancel a Booking after removing their Stored Items. A message to the Host is not sufficient for cancellation. Cancellation must be done through the Renter’s My Rentals page, which stops all future payments immediately.
7.10 Refund Policy: Renters are not entitled to refunds or prorated amounts for storage time less than the standard Monthly Period. This includes failure to cancel before the start of the next Monthly Period.
- Refund Provisions:
- Within 24 Hours/3 Days Before Start Date: If a Renter cancels within 24 hours of Booking approval or more than three days before the Start Date, they are eligible for a full refund of Total Fees and Service Fee.
- Less Than 3 Days Before Start Date: If a Renter cancels less than three days before the Start Date but not on or after it, they can receive an 80% refund of the Space Fee but no refund of the Service Fee.
- PeerVault’s Discretion: PeerVault.in may withhold payouts to Hosts to cover refunds if a Renter cancels a Booking in accordance with the terms.
7.11 Abandoned Property: Items left after the end of a Booking are considered abandoned, and the Renter gives up all rights to such items. PeerVault.in or the Host may dispose of abandoned items in any manner, including sale. The Renter must cover all costs related to the removal or disposal of abandoned items and cannot hold PeerVault.in or the Host liable for their actions regarding such property.
7.12 Contractual Lien: By using PeerVault.in and completing a Booking, Renters consent to a lien on their stored items in favor of PeerVault.in and the Host. The lien attaches when items are placed in the Space and remains until all associated fees are paid in full. The lien ensures compliance with the Terms and secures payment for all debts related to the Booking and storage. PeerVault.in may enforce the lien as outlined in the Terms, including actions specified in the Remedies section.
8. Renter Responsibility for Damage
Renters hold full responsibility for any damage caused to the Host’s property or Space by themselves or their Stored Items. To prevent any disagreements, it is advisable for Renters to document the condition of the Host’s property and Space upon initial use. This can serve as a reference point should any questions about damages arise later.
9. Use of Space and Prohibited Items
9.1 Use Of Space: The Renter agrees to use the space solely for lawful storage of personal property. Any modification to the Host’s property or installation of security systems requires mutual agreement. The Renter must follow the Host’s instructions regarding item placement. Any use other than lawful storage is strictly prohibited.
9.2 Prohibited Items: The storage of explosives, fuels, hazardous materials, pesticides, waste, firearms, ammunition, illegal substances, stolen goods, perishable or spoiled food, living or deceased animals, infested or moldy items, items emitting fumes or strong odors, improperly stored watercraft, and any items violating laws or regulations is expressly forbidden. Smoking, living, working, performing maintenance on stored items, mailing items to, or using the space as a mailing address are also prohibited.
9.3 Breach of Terms: If the Renter breaches these terms, the Host may terminate the Booking and demand removal of Stored Items. Failure to comply may result in legal actions, including forfeiture and disposal of items. The Host may report illegal activities to authorities. The Renter consents to searches by authorities without a warrant in case of suspected illegal storage. The Renter must indemnify the Host and PeerVault.in against liabilities related to the removal of stored property or breach of terms, forfeiting all paid fees upon termination.
10. Review Policy
To build a marketplace of trust, we ask our community to help ensure that reviews on PeerVault are useful, informative, and do not expose our community to harm. Therefore, we expect all reviews to adhere to this policy.
10.1 Relevance and Unbiased Opinions: Reviews should provide objective information about the host and the storage or parking experience, and should be posted in a timely manner after the booking.
10.2 Restrictions on Reviewers: Owners or affiliates of a listing, as well as competitors, are prohibited from posting reviews to avoid conflicts of interest.
10.3 Prohibition of Manipulation: Users cannot incentivize or manipulate reviews through compensation, threats, or any actions that compromise the integrity of the review system.
10.4 Content Guidelines: Reviews must not contain any unlawful, offensive, defamatory, discriminatory, or otherwise inappropriate content.
10.5 Review Moderation: PeerVault does not verify the accuracy of reviews but will remove those that violate the policy or are irrelevant. Reviews may also be removed if associated with a renter who has violated the Terms of Service.
10.6 No Endorsement: Reviews represent the personal opinions of the users and are not endorsed by PeerVault.
11.No Endorsement
PeerVault.in does not vouch for any Members or Spaces. You are responsible for vetting other Members you interact with via the Site and Services. PeerVault.in is not liable for any resulting damages. Legal actions or liabilities arising from Member interactions are limited to claims against those directly responsible. You agree not to hold PeerVault.in liable for others’ actions or inactions. Direct communication with Members about Bookings or Listings is recommended.
12. Reporting Misconduct
If you encounter a Space renter engaging in inappropriate conduct, including offensive, violent, or sexually inappropriate behavior, suspected theft, or other disturbing actions, promptly report them to the authorities and to PeerVault.in at [email protected]. Your report obligates PeerVault.in to act only within legal bounds and does not impose liability on PeerVault.in for the reported individual’s conduct.
13 Termination and Account Cancellation
PeerVault.in reserves the right to terminate these Terms, your access to our Site and Services, or deactivate your account at any time, with or without notice, and without liability. Upon termination, we will settle any amounts deemed owed to you as per our discretion and legal obligations. If PeerVault.in initiates termination, you’re still responsible for any pending charges. You can cancel your account by emailing [email protected]. Note that cancellation does not require PeerVault.in to delete or return any of your Content, including reviews or feedback
14. Disclaimers
14.1 General: When you choose to use PeerVault.in’s Site and Services, you do so entirely at your own risk. PeerVault.in does not commit to conducting background checks on any Member, although it reserves the right to do so at its discretion. The Site, Services, and all content are provided without any form of warranty, whether express or implied. Specifically, PeerVault.in explicitly disclaims any warranties of merchantability, fitness for a particular purpose, quiet enjoyment, or non-infringement, as well as any warranties that might arise from the way the Site and Services are used or traded. PeerVault.in does not guarantee that the Site, Services, or any content, including Listings or Spaces, will meet your needs or be available without interruption, secure from viruses, or error-free. Furthermore, PeerVault.in makes no warranty regarding the quality of any Listings, Spaces, Services, or content, nor the accuracy, timeliness, truthfulness, completeness, or reliability of any content obtained through the Site or Services. No advice or information, whether oral or written, obtained from PeerVault.in or through the Site, Services, or content, will establish any warranty not explicitly stated in these terms.
14.2 User Interactions: You are solely responsible for your communications and interactions with other users of the Site or Services, as well as with any other individuals you may communicate or interact with as a result of using the Site or Services, including but not limited to any hosts or renters. PeerVault.in does not undertake to verify the claims made by users of the Site or Services, nor does it review or visit any Spaces. PeerVault.in makes no representations or warranties regarding the conduct of users of the Site or Services or their compatibility with any current or future users of the Site or Services. You agree to take reasonable precautions in all communications and interactions with other users of the Site or Services, and with other individuals you communicate or interact with as a result of your use of the Site or Services, particularly if you decide to meet offline or in person, regardless of whether such meetings are organized by PeerVault.in. PeerVault.in explicitly disclaims all liability for any kind or nature of acts or omissions of any renter or other third party.
15. Indemnification
You agree to indemnify and hold PeerVault.in and its affiliates, officers, agents, and employees harmless from any claims, damages, losses, and expenses arising from:
- Your use of the Site, Services, or content, or your breach of these Terms.
- Your content uploaded to the Site.
- Injuries to persons or property related to Space usage, travel, or occupancy initiated by you.
- Your interactions with any Member, bookings, listings, or the rental conditions of a Space, including any related injuries or damages.
- Disputes with other Site users.
- Violation or misappropriation of third-party rights.
16. Feedback
PeerVault.in appreciates your feedback, comments, and suggestions for improvements (“Feedback”). You can send Feedback via email to [email protected] or through the “Contact” section of the Site. By submitting Feedback, you agree that it becomes the exclusive property of PeerVault.in. You irrevocably transfer all rights, ownership, and interests in the Feedback to PeerVault.in, including all intellectual property rights. If requested by PeerVault.in, you agree to perform any actions necessary to help secure and protect PeerVault.in’s legal rights in the Feedback.
17. Miscellaneous
These Terms constitute the complete agreement between the parties concerning the subject matter herein. Provisions that by their nature should outlast termination, such as liability limitations and indemnification, will remain in effect after termination. In any legal dispute or arbitration, the winning party is entitled to recover reasonable legal fees and costs from the other party. PeerVault.in’s rights under these Terms are not waived by any delay or failure to enforce them, unless such waiver is explicitly made in writing.
